Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Frank Schellenger, Vice Chairman, in Meeting Room A on the top floor of the Town Hall

Appointments

7:45 PM Appointment with Paul Mirabito of Ross Engineering to discuss drainage issues at the end of Bonney Hill Lane per a Certificate of Compliance Request (DEP #SE175-357)

Mr. Mirabito called to cancel his appointment with the Commission because the landscaper was not finished at Bonney Hill Lane.  The appointment has been tentatively rescheduled for May 8th, 2007.


Public Hearings

8:00 PM Request to Amend an Order of Conditions for Kevin Smith and Susan Sanders, 211 Wampatuck Street, Pembroke, MA  02359.   A proposal to the Commission to consider a revision to the accepted plan which allows a 4’7” expansion of the floor area at the rear of the house that falls within 100 feet of a Bordering Vegetated Wetland at 81 Ocean Avenue, Map 2, Lot 1501. (DEP #175-0487)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.   Mr. Smith submitted a revised plot plan dated 3/15/07 showing a 4’7” x 18 ‘ extension to the rear of the trailer to be constructed on sonna tubes.  The structure had been approved by the Zoning Board of Appeals.  Dave Harris asked if any abutters were present.  

Dean Anderson, 51 Ocean Avenue - Had no problem with the plan.

8:15 PM  Abbreviated Notice of Resource Area Delineation to determine whether the boundaries of the resource areas depicted on a Plan of Land at Adams Circle & State Street, Map 119, Lot 122  are accurately delineated for Paul Nicol represented by Land Planning, Inc., 1115 Main Street, Hanson, MA  (DEP #SE175-0521)  (New Hearing)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.  Mr. Munro of Land Planning made the presentation.  The Commission had hired a consultant per M.G.L. Chapter 44 §53G, Michele Grenier, P.W.S., C.W.S. to confirm the wetland line.  She had deemed it accurate after having walked the length of the delineation and taken soil samples.  Mr. Lindquist reiterated to those in attendance that approval of the wetland line does not infer approval for a project proposal that may come before the Commission in the future.  The abutters list was read.  Those present were:

Henry & Barbara Wrightington, Jr., 571 State Street – Commented that the area is all swamp, there is a brook that runs through the stone wall, concerned with flooding.
Mark & Erika Driscoll, 261 Adams Circle – Concerned with flooding, mentioned when it rained last year, Adams Circle was flooded with a foot of water.

8:30 PM  Continued Notice of Intent for the Taunton Watershed Pilot Wetlands Mitigation Bank which proposes to create 9.3 acres of new wetlands and enhance 16.2 acres of bog to forested wetlands at the Burrage Pond Wildlife Management Area in Hanson by BlueWave Capital, LLC, 137 Newbury Street, fl 7, Boston, MA  02116 represented by Beals & Thomas, Inc., 144 Turnpike Rd., Southborough, MA  (DEP #SE175-0516) – continued per request of applicant to 4/24/07 at 7:45 PM

Discussions

Hanson Open Space & Recreation Plan Grant
The Open Space Committee was awarded a $2000.00 Grant from the TRSWA (Taunton River Watershed Association) to help defray the cost of a new Open Space Plan.  An invitation to a Mini-Grant reception to meet the project sponsors was received as well.  
Letter from Kopelman & Paige re:  Burrage Pond Wetlands Mitigation Bank
In response to a letter from the Executive Office of Environmental Affairs (EOEA) regarding exemption from the Hanson By-Law, Kopelman & Paige, Town Counsel, had written an opinion maintaining that the Conservation Commission does have the right to enforce the By-Law citing case law.  Phil Lindquist will draft a letter to EOEA and their representative, Bluewave Strategies.
Whitman-Hanson Regional High School
Phil had met with Ernie Sandland, Clerk of the Works for the High School to discuss out-standing drainage issues.  Mr. Sandland would like to request permission to put boulders around Detention Basin D to restrict access to ATV’s.  Mr. Lindquist will outline in a letter, a list of the Commission’s concerns.  Dave Harris recommended a partial Certificate of Compliance be issued with perpetual conditions for maintenance of the drainage system and viability of the restoration area and to be recorded at the Registry of Deeds.
Dunham Farms/Occupancy Requests for five units
John Kemmett reported that he had met with a representative from the Environmental Protection Agency for a site inspection and was awaiting an opinion from them.  He suggested holding off on the occupancy requests until the report is received.
Letter from DEP regarding proposed revisions to the Wetlands Protection Act  
The Commission reviewed the letter that outlined the proposed revisions to the WPA Regulations regarding Stormwater Management Standards.
